PURCHASE PROCEDURE

1. The publication of the products displayed on the Site constitutes an invitation to the Customer to formulate a contractual purchase proposal. The order sent by the customer has the value of a contractual proposal and implies full knowledge and full acceptance of these General Conditions of Sale. The correct receipt of the Customer’s proposal is confirmed by the company Design Optical by means of a reply sent to the e-mail address communicated by the Customer and confirms only the correct receipt of the proposal within the information systems.

ACCEPTANCE OF THE GENERAL SALES CONDITIONS

1. The contract between the company Design Optical and the Customer must be considered concluded with the acceptance, even partial, of the order. This acceptance is considered tacit, unless otherwise communicated in any way by the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
2. If the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and in any case keep these general conditions of sale in compliance with the provisions of Italian legislation on distance contracts.
3. Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to people and / or things, caused by the non-acceptance or fulfillment, even partial, of an order.
4. The order sent by the customer to Design Optical through the Internet it must be completed in all its parts and must contain the elements necessary for the identification of the Customer, the products ordered and the indication of the place of delivery, under penalty of nullity. Design Optical will send the customer an e-mail confirmation of the order receipt. The delivery address must be manned, i.e. there must be a person present continuously enough to receive the package.

PRODUCT PRICES – SHIPPING COSTS – PRODUCT AVAILABILITY

6. All product prices are clearly indicated on the Site and are intended to be inclusive of VAT only.

9. Delivery times vary according to the destination area. Until the time of shipment by the Design Optical company, the Customer has the right to cancel the order or modify it exclusively by calling the number06 6574 7051.
10. The cost of each shipment, the amount of which may vary based on the weight of the package and the place of destination of the products, is added to the total price of the products and is clearly indicated and communicated to the Customer, through the Site, before the conclusion of the Contract Purchase.

12. The visual representation of the products on the Site, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics but differ in color, size, accessory products shown in the figure. In case of difference between the image and the written product sheet, the description of the product sheet always prevails.

DELIVERIES AND DOCUMENTATION

16. The delivery times are as follows may vary depending on the destination and always include 24 / 48h for preparation and 24 / 48h for transport for a total time of 48 / 96h from the order. Orders are prepared and processed from Monday to Friday. Orders received before 12 noon are processed on the same day, otherwise on the following working day. The times indicated above may not be guaranteed in particular periods of the year.
17. All product deliveries will be at Optical Design risk. The risk will be transferred to the Customer upon delivery of the products to the Customer by the shipper, the carrier or other agent appointed by Optical Design for delivery. Normally the shipment of the goods will take place by Bartolini courier. Each shipment will be traceable through the code provided by the courier used via the courier website. This code will be provided on request.
18. No responsibility can be attributed to Design Optical in case of delay in processing the order or in delivering what has been ordered.
19. Unless explicitly stated, delivery is understood to be at street level. Upon delivery of the goods by the courier, the customer is required to check: a) that the number of packages delivered corresponds to what is indicated in the transport document; b) that the packaging is intact, not damaged or wet or in any way altered, also in the sealing materials (adhesive tape or plastic straps). Any damage to the packaging and / or the product or the mismatch in the number of packages or indications must be immediately contested by placing the word “ACCEPTED WITH RESERVE” on the courier’s delivery receipt. Once the courier’s document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered. We therefore recommend, even when there are no problems on the outside of the package, to always sign the courier’s coupon with the words “Subject to control”. In fact, if this wording is missing and product damage is found, the courier will no longer be held responsible regardless of whether the insurance is present or not. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods provided in this document.
20. In the event of failure to collect the material present in stock at the courier’s warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the customer when ordering, the order will be automatically canceled, the courier will return to the Optical Design company of the neck. Together with the package, you will also receive an invoice with the list of products contained in the package and the detail of the shipping costs.

RIGHT OF WITHDRAWAL

21. Pursuant to Legislative Decree 06/09 N.206, the consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 10 days of delivery of the products. To exercise this right, the customer must send written communication by registered letter with acknowledgment of receipt to Design Optical, Viale dei Colli Portuensi, 586 | 00151 Roma – P. IVA 12262171007 – REA 1361210 | 06 6574 7051 or to the email address info@designoptical.it indicating the product or products for which it intends to exercise the right of withdrawal, provided that they are intact. Once the aforementioned notice of withdrawal has been received, the Design Optical company will quickly communicate to the customer the instructions on how to return the goods.
22. The right of withdrawal is however subject to the following conditions: – the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased; – the purchased good must be intact. By law, the shipping costs for returning the goods are charged to the customer. The shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer. In the event of damage to the goods during transport, Design Optical will notify the customer of the incident, to allow him to promptly file a complaint against the courier chosen by him and obtain a refund of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal. Design Optical does not respond in any way for damage or theft / loss of goods returned by uninsured shipments. Upon arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original packaging and / or packaging is damaged, Design Optical will deduct a percentage from the refund due, in any case not exceeding 20% ​​of the same, as a contribution to the restoration costs. If the product has been opened with the breaking of the seals, the product will not be refunded.
23. Without prejudice to any restoration costs for damages ascertained to the original packaging, Design Optical will refund the customer the full amount already paid, within 30 days of the return of the goods, by reversing the amount charged to the bank account used by bank transfer. The customer will promptly provide the bank details on which to obtain the refund.
24. The right of withdrawal is lost for lack of the essential integrity of the property (packaging and/or its contents), in cases where Design Optical ascertains: the lack of the external packaging and / or packaging original interior; – the absence of integral elements of the product; – damage to the product for reasons other than its transport. In case of forfeiture of the right of withdrawal, Design Optical will return the purchased good to the sender, charging the shipping costs to the same.

APPLICABLE LAW

1. The sales contract between the customer and the Design Optical company is concluded in Italy and governed by Italian law.
